The Las Cruces City Council will conduct a regularly scheduled meeting at 1 p.m. Monday, Aug. 2, 2021 in Council Chambers at Las Cruces City Hall, 700 N. Main St.
City Council will consider the adoption of a Resolution to establish a permit application fee for Utility Terrain Vehicles (UTVs) in Las Cruces. The Resolution would also amend the adopted City Budget for Fiscal Year 2022.
The Las Cruces Police Department (LCPD) is recommending a $15 fee for the issuance of a UTV permit. The amount would cover the cost of a vehicle sticker and would also partially pay for an officer’s time to conduct a UTV inspection.
On March 20, 2020, City Council approved Ordinance No. 2915, which authorized Utility Terrain or Utility Task Vehicles on City streets, pursuant to New Mexico state laws. On July 6, 2020, the Council approved Ordinance No. 2930, which repealed and replaced Ordinance No. 2915 to amend the definition of a UTV, enumerate areas where UTVs are prohibited from being driven, and requires a City permit to operate a UTV.
LCPD is creating a program to issue permits to drive UTVs on City streets. A fee needs to be established for the issuance of UTV permits for operations on city streets.
The Las Cruces Municipal Code defines that a permit application must be approved and a permit must be properly affixed to the UTV. Permit fees to operate a UTV within Las Cruces city limits shall be adopted by a Resolution approved by the City Council.
Additionally, City Council will consider the adoption of an Ordinance that would repeal and replace Chapter 7.5, Aviation, of the Las Cruces Municipal Code. In recent years, City staff has been evaluating and updating many administrative documents related to Las Cruces International Airport.
A proposed new Chapter 7.5, Aviation, has moved through a robust process including, a line-by-line assessment of the current ordinance; in-depth research including Federal Aviation Administration regulations and rules from similar airports; input through the Airport Advisory Board; and a review by the City's legal staff. The proposed Chapter 7.5, Aviation accomplishes three main goals: to implement clear, concise, and up-to-date language; improves flow and usability and removes redundancy; and simplifies or removes rules and regulations to support business development and aviation activity as recommended in Elevate Las Cruces.
The City’s Airport Advisory Board has recommended approval of the proposed Chapter 7.5, Aviation.
The Consent Agenda for Monday’s City Council meeting includes two items:
- A Resolution approving an amendment to the Human Resources benefits support services contract between the City and Aon Risk Insurance Services West, Inc., of Albuquerque. The proposed amendment would be to increase the agreement’s annual total amount expenditure from $75,000 to an amount not to exceed $100,000, plus applicable taxes, for an initial term through Sept. 1, 2021, and four one-year renewable options, subject to approved budget appropriations.
- An Ordinance authorizing the City to enter into a franchise agreement that would allow Comcast of New Mexico and Pennsylvania to construct, maintain, and operate a cable communications system in the City, and to maintain infrastructure within City rights of way. The Ordinance would also enable CLC-TV to begin high-definition broadcasts.
